To help with fulfilling the &#8220;written description&#8221; requirement, <a href=\"https:\/\/www.patentclaimmaster.com\/\">ClaimMaster&nbsp;<\/a>can determine whether any terms or words used in claims are not explicitly supported in the specification (i.e., all document sections other than claims), either in the same document or in separate document (e.g., for Office Action responses or Appeal Briefs). For example, if the claim recites \u201ca widget device,\u201d ClaimMaster will perform <a href=\"https:\/\/www.patentclaimmaster.com\/patent-proofreading.html\" target=\"_blank\" rel=\"noreferrer noopener\">patent proofreading<\/a> and search the specification of the patent document and determine whether this term appears in the specification.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-css-opacity\"\/>\n\n\n\n<div class=\"schema-how-to wp-block-yoast-how-to-block\"><p class=\"schema-how-to-description\">To check whether claim terms (i.e., individual words or phrases) for support in the specification, perform the following steps:<\/p> <ol class=\"schema-how-to-steps\"><li class=\"schema-how-to-step\" id=\"how-to-step-1592841840185\"><strong class=\"schema-how-to-step-name\">Open Specification Support Tool<\/strong> <p class=\"schema-how-to-step-text\">From the ClaimMaster tab, click on the\u00a0<strong>Individual Tools<\/strong>\u00a0menu, then select\u00a0<strong>Find Support for Claim Terms in the Specification:<\/strong><br\/><br\/><img loading=\"lazy\" decoding=\"async\" width=\"368\" height=\"324\" src=\"https:\/\/www.patentclaimmaster.com\/blog\/wp-content\/uploads\/2020\/06\/NewItem798.png\" class=\"attachment-full size-full\" alt=\"spec support tool\" style=\"max-width: 100%; height: auto;\" srcset=\"https:\/\/www.patentclaimmaster.com\/blog\/wp-content\/uploads\/2020\/06\/NewItem798.png 368w, https:\/\/www.patentclaimmaster.com\/blog\/wp-content\/uploads\/2020\/06\/NewItem798-300x264.png 300w\" sizes=\"auto, (max-width: 368px) 100vw, 368px\" \/><br\/><br\/><\/p> <\/li><li class=\"schema-how-to-step\" id=\"how-to-step-1593004669940\"><strong class=\"schema-how-to-step-name\">Select Claim Terms\/Words to Check<\/strong> <p class=\"schema-how-to-step-text\">Next, you will see a window that gives you a list of claim terms and individual words found in claims.  You can edit, add or remove items from both lists.  In addition, check <strong>Find text citations for supported terms\/words<\/strong> if you&#8217;d like ClaimMaster to also identify portions of the document that do support identified terms.<br\/><br\/><img loading=\"lazy\" decoding=\"async\" width=\"598\" height=\"698\" src=\"https:\/\/www.patentclaimmaster.com\/blog\/wp-content\/uploads\/2020\/06\/2023-10-13_9-27-41-1.png\" class=\"attachment-full size-full\" alt=\"find supported terms specification\" style=\"max-width: 100%; height: auto;\" srcset=\"https:\/\/www.patentclaimmaster.com\/blog\/wp-content\/uploads\/2020\/06\/2023-10-13_9-27-41-1.png 598w, https:\/\/www.patentclaimmaster.com\/blog\/wp-content\/uploads\/2020\/06\/2023-10-13_9-27-41-1-257x300.png 257w\" sizes=\"auto, (max-width: 598px) 100vw, 598px\" \/><\/p> <\/li><li class=\"schema-how-to-step\" id=\"how-to-step-1697204191273\"><strong class=\"schema-how-to-step-name\">Specify Specification Document (Optional)<\/strong> <p class=\"schema-how-to-step-text\">By default, ClaimMaster will assume that the document contains the entire specification when checking for claim term support, as would be the case with patent applications.  In addition, when checking documents that do not contain the full specification (e.g., amendments presented in Office Action responses and Appeal Briefs), you can also specify a separate document as the source for the specification.  ClaimMaster can automatically detect the application # in your Office Action response\/Appeal Brief and download the text of the specification during the check (from Google, EPO, Free Patents Online). So you don\u2019t even have to look for the text of the original application if has been published. For the Office Action responses in the unpublished applications, you\u2019ll need to point ClaimMaster to the original document with the specification.<br\/><br\/><img loading=\"lazy\" decoding=\"async\" width=\"598\" height=\"698\" src=\"https:\/\/www.patentclaimmaster.com\/blog\/wp-content\/uploads\/2020\/06\/2023-10-13_9-27-41.png\" class=\"attachment-full size-full\" alt=\"find specification support window\" style=\"max-width: 100%; height: auto;\" srcset=\"https:\/\/www.patentclaimmaster.com\/blog\/wp-content\/uploads\/2020\/06\/2023-10-13_9-27-41.png 598w, https:\/\/www.patentclaimmaster.com\/blog\/wp-content\/uploads\/2020\/06\/2023-10-13_9-27-41-257x300.png 257w\" sizes=\"auto, (max-width: 598px) 100vw, 598px\" \/><\/p> <\/li><li class=\"schema-how-to-step\" id=\"how-to-step-1593005120641\"><strong class=\"schema-how-to-step-name\">Start Search and Review Results<\/strong> <p class=\"schema-how-to-step-text\">Once you finalize your search parameters, click on <strong>Find Support for the Specified Items <\/strong>button. At that point, ClaimMaster will start searching the written description in the same or a separate specification document for the specified terms and\/or words. The search excludes the claims region in the specification document. Once ClaimMaster completes the search, you&#8217;ll be presented with a report window that shows any claim terms and words missing support in the Specification, as well as all terms with identified support. The report will also identify any terms with limited support (e.g., less than 5 hits). <br\/><br\/><img loading=\"lazy\" decoding=\"async\" width=\"450\" height=\"1016\" src=\"https:\/\/www.patentclaimmaster.com\/blog\/wp-content\/uploads\/2020\/06\/2020-06-24_9-00-52.png\" class=\"attachment-full size-full\" alt=\"spec support results\" style=\"max-width: 100%; height: auto;\" srcset=\"https:\/\/www.patentclaimmaster.com\/blog\/wp-content\/uploads\/2020\/06\/2020-06-24_9-00-52.png 450w, https:\/\/www.patentclaimmaster.com\/blog\/wp-content\/uploads\/2020\/06\/2020-06-24_9-00-52-133x300.png 133w\" sizes=\"auto, (max-width: 450px) 100vw, 450px\" \/><br\/><br\/>When reviewing the report, you can click on the individual items in the report to have ClaimMaster take you to the section of the document where the term was first used.  In addition, the citation support section will show the full text of a specific citation where support for a particular term\/word has been located. <br\/><br\/><\/p> <\/li><li class=\"schema-how-to-step\" id=\"how-to-step-1593005597861\"><strong class=\"schema-how-to-step-name\">Highlight Results In the Document (Optional)<\/strong> <p class=\"schema-how-to-step-text\">To simplify proofreading, you can highlight all support issues directly in the claims by clicking on the <strong>Highlight selected issues in claims <\/strong>button.  <br\/><br\/><img loading=\"lazy\" decoding=\"async\" width=\"400\" height=\"96\" src=\"https:\/\/www.patentclaimmaster.com\/blog\/wp-content\/uploads\/2020\/06\/2020-06-24_9-37-37.png\" class=\"attachment-full size-full\" alt=\"spec support highlight\" style=\"max-width: 100%; height: auto;\" srcset=\"https:\/\/www.patentclaimmaster.com\/blog\/wp-content\/uploads\/2020\/06\/2020-06-24_9-37-37.png 400w, https:\/\/www.patentclaimmaster.com\/blog\/wp-content\/uploads\/2020\/06\/2020-06-24_9-37-37-300x72.png 300w\" sizes=\"auto, (max-width: 400px) 100vw, 400px\" \/><br\/><br\/>This operation will highlight terms\/words directly in the claim region of the Word document. The HTML report is a little easier to review and has some nice word highlighting\/search features. At that point, ClaimMaster will start searching the written description in the same or a separate specification document for the specified terms and\/or words. The search excludes the claims region in the specification document. Once ClaimMaster completes the search, you'll be presented with a report window that shows any claim terms and words missing support in the Specification, as well as all terms with identified support. The report will also identify any terms with limited support (e.g., less than 5 hits). When reviewing the report, you can click on the individual items in the report to have ClaimMaster take you to the section of the document where the term was first used.
