This will&nbsp;often happen when&nbsp;the word itself is spelled correctly, but is the&nbsp;<em>wrong<\/em>&nbsp;word for the context, such as&nbsp;<em>nodule<\/em>&nbsp;vs.&nbsp;<em>module<\/em>,&nbsp;<em>formed<\/em>&nbsp;vs.&nbsp;<em>foamed<\/em>, <em>post<\/em>&nbsp;vs.&nbsp;<em>host<\/em>, etc.&nbsp; If the error is not caught before the patent issues,&nbsp;it will not&nbsp;only&nbsp;embarrass the attorney, but could also affect the validity of the patent, especially if the typo appears in claims and changes the meaning of the surrounding&nbsp;limitation.<\/p>\n\n\n\n<p>Surprisingly,&nbsp;such&nbsp;typos&nbsp;are also&nbsp;quite common in the issued patents because they are hard to catch and also because the USPTO often does not closely proofread the allowed claims. Consider, for example, <a href=\"https:\/\/patents.google.com\/patent\/US7061896B2\/\">U.S. Patent No.&nbsp;7,061,896<\/a>, which issued with the word &#8220;moans&#8221; instead of &#8220;means&#8221;&nbsp; and &#8220;Bald&#8221; instead of &#8220;old&#8221; in the very first claim of the patent, although there are plenty of other patents with similar typos:<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"443\" height=\"125\" src=\"https:\/\/www.patentclaimmaster.com\/blog\/wp-content\/uploads\/2018\/11\/moans1.png\" alt=\"\" class=\"wp-image-401\" srcset=\"https:\/\/www.patentclaimmaster.com\/blog\/wp-content\/uploads\/2018\/11\/moans1.png 443w, https:\/\/www.patentclaimmaster.com\/blog\/wp-content\/uploads\/2018\/11\/moans1-300x85.png 300w\" sizes=\"auto, (max-width: 443px) 100vw, 443px\" \/><\/figure>\n\n\n\n<p>The fact that these typos made it into the issued patent obviously does not great look for all of the involved parties.\u00a0 The misspelled &#8216;means&#8217;\u00a0is unlikely\u00a0 to become a real issue during enforcement proceedings because the\u00a0intended meaning of the misspelled term is quite apparent in the context of the claim.\u00a0 That said, &#8220;Bald label&#8221; is somewhat more ambiguous, so if there were several similarly spelled terms with different meanings used in the claims, the ambiguity could become significant enough to render the claim scope indefinite.\u00a0 Because spell-checkers do not work for these issues, the only way to find\u00a0such mistakes is carefully proofread the document.\u00a0\u00a0ClaimMaster makes\u00a0this <a href=\"https:\/\/www.patentclaimmaster.com\/patent-proofreading.html\">patent proofreading<\/a> a little bit easier with &#8220;Find Similarly Spelled Words&#8221; throughout&nbsp;your patent application, but in one sentence you accidentally mistype the term as &#8220;control nodule,&#8221; ClaimMaster will flag this as a possible error.&nbsp; You&#8217;ll be shown the problematic word, along with the term that we think you intended to use&nbsp; If you want to ensure that your application doesn&#8217;t have&nbsp;any typos, make sure&nbsp;to run it through both the Word&#8217;s spell-checker and&nbsp;our &#8220;<strong>Check Similarly Spelled Words<\/strong>&#8221;
